Caplan Cobb Wins Preliminary Injunction in UFTA Case
Within two weeks of the firm’s formation, Caplan Cobb’s lawyers presented evidence at a two-day preliminary injunction hearing before Judge Robert McBurney and won an asset freeze in a major UFTA case involving a series of tax lien servicing companies. Representing the owner of a $10 million judgment, Caplan Cobb sued John Ramsey, Vesta Holdings, Inc., and related entities to which they allegedly transferred assets in an effort to avoid the $10m judgment. In ordering the asset freeze, Judge Robert McBurney concluded that the transfers at issue were “heavily adorned with those ‘badges of fraud’ that are the hallmarks of fraudulent transfers.” Judge McBurney’s Order can be downloaded here.
